New build

Preparations
Make sure you prepare your total purchase cost, house value plus the additional 14% transmission costs. This includes the 10% IVA, 1.5% AJD tax, Notary, Land Registry, solicitor fees, contract of utilities and NIE (TAX) number.
Obtain a Spanish TAX number (NIE), which can be done by our legal department in a matter of days!
We can set up a Spanish bank account for you and help you with a mortgage as we have direct contact with several Spanish banks. When buying with a mortgage the additional costs as mentioned above will increase to 15/16%.

You have found your dream home
Once you have decided to purchase a New Build property, please be aware that only extras i.e. white goods, air conditioning etc. are negotiable.
We will make sure that the reservation contract is arranged as soon as possible. On signing a deposit needs to be paid which is normally between €5,000 and €10,000 subject to the builders payment structure of which can be very flexible according your needs.

Signing purchase contract
Within about 2 to 4 weeks, the purchase contract will have been drawn up and signed after which the first payment will be due. The purchase contract can be provided in several languages including Spanish. The contract will show the exact dates of the payment terms. You can choose to give a Lawyer the power of attorney in order to facilitate the procedure of the conveyancing.
In this case they will make your stage payments as per the contract and transfer the final payment into builders account in Spain.

Checking the property
Before we go to the notary, the house will be checked on several points. How is the finish? Does everything work? Do things need to be replaced?
We will assist you in this and together we will make a list of points of improvement.

Signing the deed
We will go to the notary where we, your lawyer and the project developer will be present. On this date you will be required to pay the outstanding amount of the property, plus the Notary, Land Registry, Solicitor and connection fees for water and electricity.
The key will be handed over and after signing the Title deed you will be the legal owner of the property. The inscription of the property in the Land Registry will take 2–3 months.

Moving into your new home
We ensure the property is cleaned on completion and make all the necessary arrangements to ensure moving into your new home is as smooth as possible. When you buy a new property, you will most likely need furniture, we will show you a selection of furniture shops to help you make your new house a home!

Aftersales
We recommend all clients to leave authorisation to your Lawyer allowing them to apply for the utility contracts, Water, Electricity, Gas and register for the Community and Council Tax (SUMA), as well as Residence Permit and Tourist Licence. “In Sun Properties” can help you with Home insurance, Internet, TV, Alarm System, Cleaning Service, Gardener and recommend a Builder for your reform work.
Resale

Accepted Offer
When your offer is accepted, together with you we will agree terms and conditions between the buying and selling party.
Our in-house legal Team “On The Go Legal” will deal with all the legal questions and arrange the paperwork with the bank, seller and notary.
They will carry-out the necessary checks to ensure the property is safe to buy, has no outstanding debts and that all the documentation is in order.

Signing purchase contract
At this stage you will be asked to pay the reservation fee of 10% of the total amount. The purchase contract can be provided in Spanish and in your language by your legal representative.
The contract will show the exact dates of the payment terms. You can choose to give your legal representative the power of attorney so that you do not have to be present at the notary for the signing of the Title deed. In this case they will make your stage payments as per the contract and transfer the final payment into sellers account in Spain.

Checking the property
Before we go to the notary, together we will check the property to ensure everything is functioning and in the condition of which was agreed in the purchase contract.

Signing the deed
We and the legal representative who has your power of attorney will go to the Notary to sign the final Title deed. On this date you will be required to pay the outstanding amount of the property, plus the 12.5% transmission costs.
Your legal representative will translate the Spanish Title Deed in your language. The key will be handed over and after signing the deed you will be the legal owner of the property. The inscription of the property in the Land Registry will take 2–3 months.

Moving into your new home
We ensure the property is cleaned on completion and make all the necessary arrangements to ensure moving into your new home is as smooth as possible. When you buy a resale property you might need assistance to remove unwanted furniture or to buy new, we can assist you and show you a selection of furniture shops to help you put your personal touch to your new home.

Aftersales
